📘 Mushanai – Terms of Use

1. Introduction

Welcome to Mushanai, an online marketplace that connects customers with trusted vendors across Zimbabwe. By accessing or using the Mushanai website or mobile application ("Platform"), you agree to be bound by these Terms of Use.

If you do not agree, please do not use the Platform.

2. Definitions

• "Platform" refers to the Mushanai website or app.
• "User" means any individual accessing the Platform.
• "Customer" refers to a user purchasing products or services.
• "Vendor" refers to merchants selling on Mushanai.
• "We/Us/Our" refers to Mushanai Marketplace (Mushanai Private Limited or your legal entity).

3. Eligibility

You must be:

• At least 18 years old; and
• Capable of entering binding agreements under Zimbabwean law.

4. Account Registration

Users must create an account and provide accurate information.

You are responsible for:

• Keeping your password secure.
• All activities under your account.

We may suspend or close accounts that violate our policies.

5. Marketplace Role

Mushanai acts as:

• A platform provider, not the manufacturer or importer.
• A facilitator of payments, communication, and order management.

We do not guarantee:

• Vendor performance
• Product quality
• Delivery times

However, we enforce strict vendor screening and quality control (see Customer Protection Policy).

6. Orders & Payments

Payments may be made through approved gateways (EcoCash, Mastercard, Visa, ZIPIT, etc.).

Orders are confirmed only after successful payment.

In rare circumstances, orders may be canceled due to stock shortages or pricing errors. You will receive a refund where applicable.

7. Pricing & Availability

Prices, availability, and promotions may change without notice.

Mushanai is not responsible for:

• Typographical pricing errors
• Vendor-uploaded misinformation

We reserve the right to cancel affected orders.

8. Shipping & Delivery

Delivery is handled by:

• Vendors
• Mushanai logistics partners (where applicable)

Delivery times are estimates and not guaranteed.

9. Returns & Refunds

Customers may request returns/refunds under the Mushanai Customer Protection Policy.

Refund timelines depend on:

• Payment method
• Vendor cooperation
• Verification process

10. Prohibited Activities

You agree not to:

• Engage in fraud or misrepresentation
• Sell illegal or prohibited goods
• Upload harmful files or attempt to hack the platform
• Harass or abuse staff, vendors, or customers

11. Intellectual Property

All Mushanai branding, logos, and content are owned by Mushanai.

Users may not copy, reproduce or distribute without permission.

12. Limitation of Liability

Mushanai is not liable for:

• Losses caused by vendors
• Delivery delays
• Product defects
• Misuse of the platform

Our total liability is limited to the amount you paid for the affected order.

13. Suspension & Termination

We may suspend or terminate access if:

• Illegal or fraudulent activity is suspected
• Platform rules are violated
• False information is provided

14. Governing Law

These Terms are governed by the laws of Zimbabwe.
